General conditions of sale

Preamble

The company MD Décoration aims to create, develop and market scented candles, room fragrances and decorative items. Scented candles and room fragrances are manufactured in France. These General Terms and Conditions of Sale are intended to define the rules applicable to the sale of items offered on the website www.secretdapothicaire.fr:

BETWEEN

The company MD Décoration, SAS with capital of 1,000 euros, registered 917 780 470 and whose head office is located at 55 Rue Gambetta 14800 Deauville. The company MD Décoration owns the website www.secretdapothicaire.fr (hereinafter referred to as The Site). The company MD Décoration will be hereinafter referred to as The Seller

AND

Any natural person, of legal age, non-trading, having the legal capacity to contract and wishing to make a purchase on the site www.secretdapothicaire.fr (This natural person will hereinafter be referred to as the Customer).

MD Décoration reserves the right to modify these general terms and conditions of sale at any time and without notice. The applicable general terms and conditions of sale are those in force on the Site on the date the Customer places the order.

Article 1. Products

The products offered for sale by the Seller are those presented on the Site and which are not indicated as “currently unavailable” or “sold”.

Each product is described using photos and text, specifying in particular its composition. Unless otherwise stated, the item purchased is exactly the one shown in the photo and not another copy. However, minor differences, in particular in color intensity (related to different types of screens, brightness when taking the photos, etc.) or dimensions, may exist between the photos, the description and reality. This cannot constitute a defect or proof of non-conformity.

The Seller takes the greatest care in choosing, selecting, processing and reusing the materials used, in compliance with the rules of the art and artisanal manufacturing. They may contain small defects that are evidence of this type of manufacturing. If they have been used to make a particular item, it is because the Seller considered that they were suitable for use without compromising the aesthetics or quality of the item produced.

It is with full knowledge of the facts, after reading these general conditions of sale, that the Customer purchases a handmade item on the Site. In case of doubt, the Customer may contact the Seller's customer service at lescousinesdeauville@gmail.com, possibly indicating the reference of the item concerned.

Article 2. Prices

The prices indicated in the descriptions of items offered for sale are indicated including tax at the VAT rate applicable in metropolitan France for this type of item on the date of validation of the order. The VAT and excluding tax price details are indicated when validating the basket.

All transactions are made exclusively in Euros. The invoice will be issued in Euros.

The prices are those indicated on the site at the time of order validation. Before making the payment, the Customer will go through a payment validation step summarizing all the items he wishes to purchase, with their individual price, the delivery price and the total (excluding VAT, VAT and including VAT).

Delivery costs are indicated on the order summary and BEFORE the validation of the order by the Customer. They depend on the place of delivery. They are the responsibility of the CUSTOMER unless otherwise stated (The Seller reserves the right to temporarily offer free shipping costs, for example for a particular item or from a certain purchase amount or in a certain geographical area).

Article 3. Order and payment

The Customer, during his visit to the Site, selects the items he wishes to purchase by clicking on the "Add to cart" button. He then views his entire cart by clicking on "Cart". He can then modify all or part of his "Cart". He must then specify the chosen delivery address. The shipping costs are then calculated accordingly. The totals excluding VAT, VAT and including VAT are then calculated and indicated.

The payment method (CB) must be chosen by the Customer.

The Customer must confirm, by checking the appropriate box, that he has read the general conditions of sale (accessible via a hyperlink or in the links at the bottom of the page).

The order must then be validated by the Customer by clicking on the “Validate my order” button. The Customer will then access the secure payment screen:

via the Seller's partner, namely Stripe Inc, depending on the payment method chosen. All transactions during payment are secure and no banking data is stored by the Seller.

If payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.

An order confirmation email will then be automatically sent.

In case of payment failure, an email will be automatically sent. The Customer will then be invited to contact the Seller's customer service via lescousinesdeauville@gmail.com

Before finalizing any order, the Customer must be registered on the Site via the My Account section. In particular, he must provide a delivery address, a contact email address which will also serve as an identifier and a telephone number. He must choose a personalized password. Identifier (contact email address) and password will subsequently be necessary and sufficient to identify himself.

The Seller reserves the right not to validate the order or even to close an account in the event of:

abusive or abnormal claims

abnormal orders

abusive exchanges and returns

ongoing disputes with the Client

or if the Client proves not to meet the criteria defining “The Client” as defined in the preamble to these conditions

The price of the items is payable in cash, in Euro, on the day the order is validated.

In the event of non-payment, an incorrect or incomplete address, a data entry error or any other problem with the Customer's account, the Seller reserves the right to block the order pending resolution of the problem.

Article 4. Delivery

Secret d'Apothicaire undertakes to ship the items ordered as quickly as possible: shipments are generally made within 72 hours (no shipments on Saturdays and Sundays) following validation of the order and at the latest within 5 working days following validation of the order (unless explicitly stated otherwise on the site and the order validation screen, in particular in the event of closure for holidays)

Shipments are made by post (Colissimo tracking), with tracking number. An email indicating the tracking number is sent to you as soon as the shipment is made. For mainland France, the deadline guaranteed by La Poste is 48 hours for Colissimo. A complaint can be made in the event of non-compliance with this deadline.

Any customs fees, import taxes or customs formalities are the responsibility of the customer.

Article 5. Reception, complaints, returns

The carrier and delivery are provided by external companies to which the Seller entrusts the packages. This is exclusively the Post Office via its Colissimo offers – and its partners for abroad.

At the time of delivery (handover of the package by the carrier), the Customer is required to check the conformity of the package and the products contained in the presence of the carrier. It should be noted that La Poste, like all carriers, does not take into account complaints concerning packages that are not opened in front of the delivery person.

In case of doubt during delivery, the Customer must apply the procedure provided by the carrier or even refuse the package.

Anomalies upon delivery may be: damaged package, missing, soiled or damaged items, non-compliant items, etc. They must be notified within 48 hours of receipt to the Seller's customer service:

Right of withdrawal

The Customer has a period of 7 working days from the date of receipt of the order to return the products ordered, without justification or penalty. The following return procedure must be strictly followed:

The Customer must first notify the Seller by e-mail and complete the return form which will then be sent by e-mail.

the return slip must be attached to the package

The returned item(s) must be in perfect condition, unsoiled, never used and in their original packaging, accompanied by their original labels if any.

The risks and costs of return are the responsibility of the Customer. The Customer is required to return the item(s) with insurance covering the entire purchase price.

Once the returned item has been received by the Seller, the refund including tax (purchase price excluding delivery costs) will be made by crediting the bank card used at the time of payment, or by sending a check by post within 7 calendar days following the date of receipt of the returned item (unless otherwise stated by email – in particular in the event of closure for holidays or force majeure).

Any customs fees and taxes paid by the customer upon receipt will not be refunded.

No cash on delivery returns will be accepted.

Complaints

In the event of non-conformity noted on an item, the Customer must notify the Seller's customer service by email at lescousinesdeauville@gmail.com. A complaint/return form will be sent to him.

The item must be returned with the completed claim/return form. It must be returned complete and with any accessories.

At this stage, the return costs and transport risks are the responsibility of the Customer. Once the defect or non-conformity has been noted by the Seller, the latter will offer the Customer:

or exchange with a similar item (the shipping costs of the replacement item will be free and the return costs of the first item will be reimbursed by check according to the Colissimo France and International price list)

or a refund including delivery and return costs within 7 calendar days following the date of receipt of the returned item (unless otherwise stated by email – in particular in the event of closure for holidays or force majeure)

Any customs fees and taxes paid by the customer upon receipt will not be refunded.

Limitation of Liability

All items sold on the Site are made for individual use. The Seller cannot be held responsible for the consequences of inappropriate use or failure to follow the usage instructions specific to this type of product.

Placing an order via the Site implies tacit acceptance of the rules and risks of using the Internet, whatever they may be, it being understood that the Seller and the service provider chosen for the payment system (Stripe Inc.) strive to limit any potential inconvenience but cannot be held responsible for any direct or indirect damage resulting from the use of the Site.

Article 6. Dispute

If any of the terms of these General Conditions are found to be null and void, illegal or unenforceable by a court decision, the other provisions of the General Conditions of Sale shall remain in force.

These conditions will be executed and interpreted in accordance with French law.

In the event of a dispute, the Customer and the Seller undertake in good faith to try to find an amicable solution as a priority. Failing this, the courts on which the Seller's head office depends shall have sole jurisdiction.

Article 7. Intellectual Property

The Site www.secretdapothicaire.fr is the exclusive property of the Seller (the company MD Décoration). Any reproduction of images, in whole or in part, is prohibited without the prior written consent of the company Secret d'Apothicaire.

All items offered for sale or displayed in mood or individual photos are the exclusive property of MD Décoration. The same applies to all texts and graphics on the site.

All models presented are the exclusive property of the company Secret d'Apothicaire and are protected by all texts governing intellectual property, trademarks and copyright.

Any use of a visual, graphic or textual element of the site (whether for personal or professional use) without prior written authorization constitutes counterfeiting and is punishable under intellectual property law.

Article 8. Confidential data

The website www.secretdapothicaire.fr is in the process of being declared to the CNIL.

In accordance with the law of January 6, 1978, the user has the right to access, delete and rectify all data concerning him/her.

The Customer is informed of the use of cookies by the Site in particular to facilitate connection to his account on each visit.

The Seller undertakes not to provide any external service provider with its customers' account and order data. Each customer's order data is stored by the Site and can be viewed exclusively by each customer.

Any order validation implies complete acceptance of all general conditions of sale as written on the date of validation.
